WEDDING PHOTOGRAPHY & VIDEOGRAPHY CONTRACT

Wedding Venue: Corazón Hotel, Los Cabos, Mexico

Lead Photographer: Bardot Cristian Carrillo Lira

  1. SERVICES INCLUDED

The Clients agree to contract Hilo Rojo Photo for wedding photography and video services under the Amatista Package, which includes 8 hours of full wedding coverage, consisting of professional photography, cinematic video coverage, and the Rose Quartz Creative Content Collection for 8 hours.

Deliverables include:

  • A minimum of 950 edited digital photographs with basic color correction.
  • One cinematic highlight film approximately 10 to 12 minutes in length, featuring the best moments of the wedding.
  • Three to four vertical social media reels, delivered within 3 business days following the wedding.
  • One minute highlight video optimized for social media platforms.
  • A minimum of 90 raw video clips delivered in original format.
  1. RETAINER & PAYMENT
  • The total agreed package price is $8,990 USD, including Mexican Tax (16%).
  • The Client agrees to pay a non-refundable retainer of $1,798 USD, tax included, to secure the wedding date.
  • The retainer may be paid via PayPal or cash, whichever is most convenient for the Client. Bardot@hilorojophoto.com
  • The remaining balance is as follows:
    • PayPal: $7,192 USD tax
    • Cash: $6,041.00 USD
  • If the remaining balance is paid in cash on the wedding day, the applicable tax may be omitted.
  • No photographs, videos, or deliverables will be released until full payment has been received.
  1. CANCELLATION OR RESCHEDULING
  • The retainer is non refundable under all circumstances.
  • In the event of postponement, all payments made will be applied toward a new wedding date, provided the new date occurs within one calendar year of the original wedding date and is subject to availability.
  • If cancellation occurs within thirty days of the scheduled wedding date, all payments are forfeited, and a new retainer will be required to reserve a future date.
  • Clients must provide a minimum of thirty days written notice for any cancellation or postponement.
    1. EXCLUSIVE COVERAGE
    • Hilo Rojo Photo shall be the exclusive professional photography and videography provider for the wedding and related events covered under this agreement.
    • The Clients agree not to hire or engage any other professional photographer or videographer during the contracted coverage period.
    1. ONLINE GALLERY & DELIVERY TIMELINES
    • The Clients’ online gallery will remain active for fifteen days from the delivery date.
    • If files are not downloaded within this period, a new download link may be requested within three months of the original delivery date.
    • Hilo Rojo Photo will archive all client materials for one year. After this period, the Photographer is not responsible for retaining or re delivering files.
    • Clients are solely responsible for backing up and storing their delivered photographs and videos.
    • Clients acknowledge and accept the Photographer’s artistic, documentary, and candid style, including natural posing.
    • No refunds shall be issued due to dissatisfaction with artistic style, as this has been agreed upon prior to signing this agreement.
      1. USAGE RIGHTS & PUBLICITY
      • Hilo Rojo Photo retains the right to use photographs and video content for portfolio, website, marketing, and social media purposes, unless otherwise agreed upon in writing by both parties.
      1. LIMITATION OF LIABILITY
      • In the event of equipment malfunction, theft, loss, or damage of materials beyond the Photographer’s control, liability shall be limited to the total amount paid under this agreement.
      • Clients assume all risks related to the wedding and associated activities. Hilo Rojo Photo shall not be held liable for personal injury, property damage, or loss of life, except in cases of proven intentional misconduct.
      1. ENTIRE AGREEMENT
      • This Agreement constitutes the entire understanding between the parties. No other agreements, promises, or representations, whether verbal or written, shall be binding.
      • This Agreement becomes valid only upon execution by both parties and receipt of the non refundable retainer.
