WEDDING PHOTOGRAPHY & VIDEOGRAPHY CONTRACT

Wedding Date: June 20th, 2026
Venue: Villa Marcella, Pedregal Los Cabos

Photographer: Hilo Rojo Photo – Bardot Carrillo

Selected Package: AMBAR

Includes 8 hours of photography coverage with 2 photographers and drone service.
Subtotal: USD 4,350 + 16% Mexican Tax
Total: USD 5,046

A minimum of 650 high-resolution digital photos will be delivered, professionally selected and color-corrected, through an online gallery.
A sneak peek of 60 images will be delivered within 2–4 days after the event.

    Retainer & Payment

    To reserve the wedding date, the client agrees to pay a non-refundable retainer of USD 1,000 to Hilo Rojo Photo.
    The remaining balance of the selected package must be paid no later than one week before the wedding day.

    Hilo Rojo Photo will not deliver any preview or final images until full payment has been received.

    Inclusions

    The client’s complete online gallery will be available for digital download.
    All delivered images will be color-corrected and tone-graded in Hilo Rojo Photo’s artistic style.

      Meals for Photographers

      For events lasting 6 hours or longer, the client agrees to provide meals for both photographers during the dinner or reception time.
      This ensures that the team remains on-site and available to continue capturing important moments without interruption.

        Rescheduling or Cancellation

        In the event of a postponement or cancellation, the retainer is non-refundable under all circumstances.
        Clients must notify Hilo Rojo Photo at least 30 days in advance of any cancellation or postponement.

        • All funds paid may be applied to a newly rescheduled date within one calendar year of the original wedding date, subject to photographer availability.
        • If the cancellation occurs within 30 days of the scheduled wedding, all monies paid are forfeited, and a new retainer will be required to secure a new date.

        Obligations & Timelines

        To secure the wedding date, clients must sign this agreement and pay the non-refundable retainer.
        By signing, the clients acknowledge that they have read and accepted all terms and conditions herein.
        This contract becomes valid only upon countersignature by Hilo Rojo Photo.

          Exclusive Coverage

          To ensure clarity on the wedding day, Hilo Rojo Photo will be the exclusive professional photography and/or videography team for the event.
          Clients agree not to hire or engage any additional professional photographers for coverage of the wedding or related events.

          Online Gallery & Digital Files

          The client’s gallery will remain online for 7 days after delivery.
          If the gallery is not downloaded during that time, clients may request a new download link within 3 months of delivery.

          Hilo Rojo Photo will store all wedding materials for 1 year. After that period, Hilo Rojo Photo is not responsible for maintaining or reproducing the files.
          Clients are responsible for downloading and backing up their images to ensure long-term preservation.

          Artistic Style

          By signing this contract, the clients acknowledge that they are familiar with and appreciate the artistic, candid, and documentary style of Hilo Rojo Photo, including naturally posed portraits.

          However, considering the clients’ request regarding editing preferences, Hilo Rojo Photo will present two editing style proposals after the event for the clients to review and approve before proceeding with the final wedding edit.

          No refunds shall be granted based on dissatisfaction with artistic style, editing, or creative direction once the final style has been approved by the clients.

            Usage Rights

            Hilo Rojo Photo retains the right to use and display images from the wedding for promotional, marketing, and portfolio purposes, including on social media and the website.

              Photographic Archive & Liability

              Upon delivery of the final high-resolution gallery, the client assumes full responsibility for the safekeeping of their images.
              Hilo Rojo Photo will not be required to reproduce or replace any files lost, damaged, or destroyed after 3 months from delivery.
              It is highly recommended that clients create multiple backup copies of their wedding photographs.

              In the rare event of a technological malfunction, data loss, or damage beyond the photographer’s control, Hilo Rojo Photo’s liability is limited to the amount paid for the contracted services.

                Assumption of Risk & Indemnification

                Clients acknowledge that participation in wedding activities involves inherent risks.
                Clients agree to indemnify and hold Hilo Rojo Photo harmless from any liability for personal injury, property damage, or loss of life arising from or related to the wedding event, except in cases of proven intentional misconduct by Hilo Rojo Photo.
                In the event of such proven misconduct, clients shall be entitled to a full refund of all monies paid.
